Distracted Driver Causes Auto Accident
Our client was driving to work one Monday morning, just as he had every day for 20 years, however this trip was anything but routine. As he was traveling north on a divided highway, he was struck in the driver's door by a full size van. The van was traveling east and had crossed the two southbound lanes of traffic but apparently didn't see our client in his new, blue car heading north and she hit him. The driver of the van was talking on her cell phone at the time and simply not paying attention. Both vehicles careened off the road after the impact.
Our client was extracted from his car with the jaws of life and was taken by helicopter to St. Mary's Hospital in Rochester, MN. There he underwent immediate surgery for a fractured femur. His injuries included a left femur fracture, a compound fracture of the right ankle, a left elbow fracture, a fractured collar bone, a fractured left cheek bone and orbit, a collapsed left lung and significant lacerations to his nose and left eye. He was in the hospital for nearly a month. Our client missed 6 months of work after the accident and endured a lengthy rehabilitation. The driver of the van that hit our client, and her 14 year old son who was a passenger, were not injured in the accident.
William Bongard assisted our client in obtaining disability benefits and pursued a claim against the at-fault driver and obtained a settlement in the amount of $750,000.
