Insurance Loophole Affects ATV Accident Victim
One of our clients suffered a serious brain injury when he lost control of an ATV and hit a tree. Just 15 years old at the time of the accident, he was operating the ATV while performing clean up work for a landscape business. The family's health insurance company fought responsibility for his medical bills and the workers' compensation insurance company denied liability.
Attorney Mike Scully fought the insurer's denials all the way to the Supreme Court and won workers' compensation benefits by establishing that our client's injuries were sustained in the course of his employment. The injuries were deemed catastrophic, entitling the victim to weekly compensation until at least age 67 and medical benefits and home health care for the rest of his life.
