Insurance Coverage Dispute Won By Cory Whalen After Car Accident
Our client was a Russian immigrant who came to this country after working for several years as a professional in Moscow. Our client was able to speak limited English. Shortly after purchasing a new vehicle in the United States, our client was involved in a car accident on snowy roads.
After purchasing the vehicle, the client had promptly insured it with a well known insurance company that does extensive business in Minnesota. As part of the agreement, he purchased medical expense coverage for injuries sustained in a motor vehicle accident. Following this accident, the insurance company denied the claim and argued that the client was attempting to bring fraudulent medical claims under his insurance policy. The insurance company also argued that he lied to the State Patrol officer at the scene. Despite our client's pleas to the insurance company that he had not engaged in fraud, the insurance company ignored the language barriers and sued our client for insurance fraud and suspended any and all benefits under his policy.
Cory Whalen tried the case in Hennepin County District Court. A verdict was returned in favor of our client and completely exonerated him of any fraud or misconduct. Cory Whalen then submitted several thousand dollars in medical expenses in an arbitration hearing and prevailed entirely for our client.
