Good Samaritan Killed Helping Others
A Hastings teenager stopped to change a flat tire for a stranded motorist on the narrow median shoulder on Interstate 94 just east of the Mississippi River. Trying to avoid a traffic backup, the defendant pulled into the median area and hit the back of the stranded Ford Explorer. The defendant's car landed on our client. Numerous motorists stopped and pulled the defendant's car off our client. He died from his injuries a day later.
Witnesses testified that the defendant appeared to lose control as she switched from the center to the far left lane and then hit the parked vehicle. An accident reconstruction report concluded she was driving between 55 and 60 miles per hour when she started skidding on the 55 mph-limit highway.
Jeffrey Sieben represented the teenager's family; and settled the claim against the at fault driver for the policy limits of $150,000.
